Georgia law treats a loan secured by a vehicle title as a pawn transaction under the Official Code of Georgia Annotated, Title 44 Property (O.C.G.A. Sections 44-12-130 through 44-12-138), so lenders offer the product as a title pawn rather than a loan. Loans Inc connects Georgia residents with participating independent lenders that offer this product. We are not a lender; the lender you are matched with decides whether to approve you and on what terms. This page explains what Georgia law allows, who enforces it, and what to check before you sign.

Are title loans legal in Georgia?
Yes, as a title pawn. The provisions that apply are O.C.G.A. Sections 44-12-130 through 44-12-138 (esp. 44-12-131 duration/possession/charges and 44-12-138 disclosure ticket).
The operative language in the statute reads: “Unless otherwise agreed, a pawnbroker has upon default the right to take possession of the motor vehicle.”
Recent change: No enacted 2023-2026 change seen. HB 300 (2025-2026 Regular Session, legis.ga.gov) would amend Titles 43 and 44 ‘to exclude motor vehicle certificates of title from pawn transactions’, remove the deemed-possession rule and pawnbroker repossession/fee provisions; status history: House Hopper 02/05/2025, House First Readers 02/06/2025, House Second Readers 02/10/2025, committee Banks & Banking, no votes recorded.
Who regulates title lenders in Georgia
No state financial regulator: Georgia Department of Banking and Finance states it ‘does not license or have jurisdiction over pawnbrokers, pawn transactions, or title pawn transactions’; municipal authorities may license pawnbrokers by ordinance; consumer complaints go to local criminal authorities / Georgia Attorney General Consumer Protection Division. See the state agency notice for details. Complaints can be filed with the Consumer Financial Protection Bureau and the state attorney general.
Rate caps and fees in Georgia
Georgia Attorney General Consumer Protection Division page: interest capped at 25 percent monthly for the first three months and 12.5 percent monthly thereafter; DBF page: ‘Pawnbrokers are limited in the amount of interest they may charge in connection with a pawn transaction. O.C.G.A. Section 44-12-131’ (statute subsection text itself not read – see notes).
Separately, federal law caps the Military Annual Percentage Rate at 36% for active-duty service members and their dependents on most consumer credit, including title loans (Military Lending Act, 32 CFR Part 232).
Rates, fees, and repayment terms are set by the lender you are matched with and vary by state. Before you sign, the lender will give you a full written disclosure of the APR, fees, payment schedule, and total cost. Loans Inc does not set or guarantee any loan terms.
What the Georgia cap means in dollars
Illustrative only. On a $1,000 loan for 30 days, the maximum finance charge allowed by O.C.G.A. 44-12-131 as described by the Georgia Attorney General (25% per month for the first three months) is about $250, for a total repayment of about $1,250. A lender may charge less than the maximum, and the written disclosure the lender gives you before you sign is the figure that counts. This is an illustration of a statutory ceiling, not an offer from any lender.
Loan terms in Georgia
‘All pawn transactions shall be for 30 day periods but may be extended or continued for additional 30 day periods.’ (O.C.G.A. 44-12-131(a)(1), read on the official OCGA portal). No limit on number of extensions seen.
Repossession rules in Georgia
On default the pawnbroker may take possession of the motor vehicle ‘without judicial process if this can be done without breach of the peace or may proceed by action’ (44-12-131(a)(3)); DBF states ‘O.C.G.A. Sections 44-12-131 and 44-12-138 cover repossession of motor vehicles following a title pawn transaction’; the AG page says the pawnbroker ‘can also charge you certain fees if he or she actually repossesses the vehicle’.
A title loan is secured by your vehicle. If you do not repay according to the loan agreement, the lender may repossess your vehicle. Late or missed payments may be reported and may affect your credit. If you are struggling to pay, contact the lender before the due date; the options available to you are set by the loan agreement and Georgia law.
Your rights as a borrower in Georgia
Written ‘disclosure ticket’ required for every pawn transaction (O.C.G.A. 44-12-138, per DBF); for vehicle pawns the pawnbroker must give the written statement ‘Failure to make your payment as described in this document can result in the loss of your motor vehicle. The pawnbroker can also charge you certain fees if he or she actually repossesses the vehicle.’ (44-12-138(b)(3), per AG page); lease-back of a pawned vehicle during the transaction is prohibited (44-12-131(a)(2)).
