Are title loans legal in Kansas?
Yes. The provisions that apply are K.S.A. 16a-2-401; see also K.S.A. 16a-5-111 (cure of default) and 16a-5-103 (deficiency restrictions).
The operative language in the statute reads: “In Kansas, a Title Loan is written as an Open End Line of Credit.”
Recent change: L. 2024, ch. 6 (effective January 1, 2025) amended K.S.A. 16a-2-401 (closed-end cap now stated as a flat 36% per annum), amended 16a-5-103 and 16a-5-111, and repealed 16a-5-110 (former notice of right to cure) – per history notes on the Revisor pages. No change to the open-end ‘any rate agreed’ provision.

Rate caps and fees in Kansas
Open-end credit (the form OSBC says title loans take): finance charge at any rate agreed to by the parties, subject only to the prepaid-finance-charge limit (K.S.A. 16a-2-401(1)). Closed-end consumer loans: periodic finance charge, actuarial method, not to exceed 36% per annum (16a-2-401(2)). Prepaid finance charges limited to the lesser of 2% of the amount financed or $300 (16a-2-401(4)). OSBC FAQ: ‘A licensed Supervised Lender may charge a finance charge at any rate agreed to by the parties for an Open End Line of Credit.’.
Separately, federal law caps the Military Annual Percentage Rate at 36% for active-duty service members and their dependents on most consumer credit, including title loans (Military Lending Act, 32 CFR Part 232).
Rates, fees, and repayment terms are set by the lender you are matched with and vary by state. Before you sign, the lender will give you a full written disclosure of the APR, fees, payment schedule, and total cost. Loans Inc does not set or guarantee any loan terms.
What the law says about cost in Kansas
Kansas law sets no maximum interest rate for this loan (K.S.A. 16a-2-401(1)). The lender sets the rate by contract and must disclose the APR, fees, and total cost in writing before you sign. Because there is no ceiling, no illustrative maximum can be shown for Kansas; read the disclosure carefully, compare offers, and see our costs and rates guide for how title loan pricing works.
Repossession rules in Kansas
Right to cure (K.S.A. 16a-5-111): after a consumer has been in default for 10 days on a required payment the creditor may give written notice of the right to cure; for a default consisting only of a missed payment the creditor may not accelerate or take possession of collateral until 20 days after the notice; the consumer may cure by tendering all unpaid sums plus late fees; only one cure notice is required per obligation. Collateral may be taken without judicial process only ‘without entry into a dwelling and without the use of force or other breach of the peace’ (16a-5-111(5)). Deficiency limits in 16a-5-103 apply only to consumer credit sales and loans subject to defenses arising from sales, so they do not generally reach title loans.
A title loan is secured by your vehicle. If you do not repay according to the loan agreement, the lender may repossess your vehicle. Late or missed payments may be reported and may affect your credit. If you are struggling to pay, contact the lender before the due date; the options available to you are set by the loan agreement and Kansas law.
Your rights as a borrower in Kansas
Prepaid finance charges are fully earned and non-refundable unless the parties agree otherwise in writing (16a-2-401(4)); on a refinancing within 12 months, new prepaid finance charges limited to the lesser of 2% of the additional amount financed or $300 (16a-2-401(5)); OSBC FAQ: when the loan is repaid the lien is removed.
