Rate caps and fees in Minnesota
Regulated lenders (ch. 56) may contract for interest and charges as provided in 47.59 (56.131 subd. 1). 47.59 subd. 3(a): finance charge on consumer loans not to exceed the greater of (1) 21.75% APR or (2) 33% per year on the unpaid principal not exceeding $1,425 plus 19% per year on the part exceeding $1,425; a blended single rate is allowed (subd. 3(b)). Delinquency charge: 5% of the payment or $9.88, whichever is greater, after the 10th day (47.59 subd. 6). Separate products: consumer small loans (unsecured, up to $350) and consumer short-term loans (up to $1,300) may carry up to 50% APR and, if over 36% APR, must comply with the 47.603 ability-to-repay analysis (47.60 subd. 2; 47.601 subd. 2(e)-(f)).
Separately, federal law caps the Military Annual Percentage Rate at 36% for active-duty service members and their dependents on most consumer credit, including title loans (Military Lending Act, 32 CFR Part 232).
Rates, fees, and repayment terms are set by the lender you are matched with and vary by state. Before you sign, the lender will give you a full written disclosure of the APR, fees, payment schedule, and total cost. Loans Inc does not set or guarantee any loan terms.
What the Minnesota cap means in dollars
Illustrative only. On a $1,000 loan for 30 days, the maximum finance charge allowed by Minn. Stat. 47.59 subd. 3 (33% per year on principal up to $1,425) is about $27.5, for a total repayment of about $1,027.5. A lender may charge less than the maximum, and the written disclosure the lender gives you before you sign is the figure that counts. This is an illustration of a statutory ceiling, not an offer from any lender.
Repossession rules in Minnesota
A title loan is secured by your vehicle. If you do not repay according to the loan agreement, the lender may repossess your vehicle. Late or missed payments may be reported and may affect your credit. If you are struggling to pay, contact the lender before the due date; the options available to you are set by the loan agreement and Minnesota law.
Your rights as a borrower in Minnesota
Regulated lender additional charges limited to enumerated items such as filing fees and 47.59 administrative fees (56.131 subd. 2); no splitting of loans to obtain higher rates (56.131 subd. 3); debtor may not be required to pay attorney’s fees except in real-estate foreclosure (56.131 subd. 5); early prepayment entitles borrower to refund of unearned charges; no person may make loans at rates above the general legal rate without a ch. 56 license (56.01(a)).
